This page describes the terms and conditions on which we will supply any of the products listed on our website www.giddygatefarm.co.uk to you.

Please read these terms and conditions carefully before ordering any products from our site.

You should understand that by ordering any of our products you agree to be bound by these terms and conditions.

3) How we may contact you

By telephone or by writing to you at the postal address or email address you provided when placing your order. (The use of the term ‘write’ or ‘writing’ within these terms and conditions includes the use of email).

4) Placing an order

You can use our website to place an order, by selecting the product you wish to order and adding it to your basket. Items that you do not require can be removed from your basket at any time prior to order completion.

5) Our contract with you

 When you place an order with us you are making an offer to purchase goods. We acknowledge acceptance of your order when we email, write or call you to accept it, at this point a contract will come into existence between you and us.

By placing an order with us, you agree and accept these terms, as well as our privacy policy.

Upon us accepting your order it will be designated an order number. Please quote this number in any correspondence relating to your order.

We only sell products from our website to the UK. We do not currently deliver to Northern Island, The Channel Islands, Isle of Man, The Republic of Ireland or internationally.

In some circumstances we may not be able to accept your order, including but not limited to; the product is out of stock, there is an error in the price or description that we have identified, there are unexpected resource limitations that we could not reasonably plan for or we are unable to meet the delivery deadline specified by you at the time of order. If we cannot accept your order, you will be informed, and we will not charge you for the product.

6) Products

Images of products on our website are for illustrative purposes only. We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor/device’s display of any colour will accurately reflect the colour of the actual goods. Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith. We take no responsibility for incorrect information on products.

We make every effort to be accurate and consistent. Bird food products are mainly seed based and our homemade seed mixes may contain some variation from order to order, or from time to time. On our own seed mixes and straights that are bagged by us at our farm, there is a tolerance of weight variance of up to 5% of that indicated on our website.

Product packaging may vary from that illustrated on our website.

7) Changing an order

We understand that consumers occasionally wish to make changes to an order. Please contact us as soon as possible by telephone or by email if you would like to change an order.

We will inform you if the change is possible and inform you of any price changes, delivery changes (including price and timing) which may result from such a change. We will ask you to specifically confirm that you wish to proceed with the changed order.

8) Our rights to change products

We may make minor changes to products in order that they comply with any relevant laws and regulatory requirements.

If we are required to make significant changes to a product, we will contact you by phone, email, or post. You may end the contract that exists between us and receive a refund from us for any such products paid for but not yet received.

9) Stock

If at any stage any goods you may have ordered are found to be out of stock or are not expected to be back in stock within 7 days of order placement, we will notify you by email.

You will have the option of; waiting for the item to come in stock, for us to send other goods to you that are of the same value as replacement, or a refund issued by the original payment method.

10) Price

The price of the product will be displayed on our website or it may in some circumstances have been communicated you over the telephone or via email.

All prices on our website are in UK pounds and are inclusive of VAT at the current rate.

We take all reasonable care to make sure that prices shown on our website or communicated to you are accurate. We accept that it is possible, despite our best and reasonable efforts that products may be shown with incorrect pricing.

If, you have placed an order with us, and before we have accepted it we find that the correct product price is actually LESS than the price stated on your order date we will charge you the (correct) lower amount. If the correct price is HIGHER than the price stated to you on the order date, we may contact you to ask for further instruction as whether you wish to proceed with your order at the revised (correct) price.

If, at the time you place your order the price stated in error for a product is considered to be so obvious and unmistakeable that it is reasonable to consider that it would be recognised as having been stated in error and therefore considered as mispricing, we may not accept the order, or we may choose to end the contract. We may require return of any good provided and refund you the amount paid for the products in question.

11) Promotional Codes

Promotional codes are limited to one per customer, per purchase and are limited to one time use only per customer. Some promotional codes can only be used on full price merchandise and may not be combined with other promotions. Some promotional codes may be used on merchandise that has already been reduced in price.

Promotional codes which involve a free gift are only valid for as long as stocks of the free gift remain. 

The promotional codes do not have a cash value. If a return is made you will receive a refund or exchange of goods only to the value of that which you paid, that being the total amount at checkout less the value of the promotional code used.

12) Promotions

Promotional prices only apply during the period stated.

13) Reviews

Reviews that are left on our website are from independent individuals not in the employment of Giddy Gate Farm. We take no responsibility for incorrect information that may be contained within reviews.

14) Payment

We use secure, payment facilities for online purchasing. For more information please read our privacy policy. You may pay for your order online using major credit cards and debit cards. Carriage charges will be shown prior to you placing your order. You will be required to pay for products before we dispatch them.

15) Delivery and carriage

Our delivery costs to you are set out on our website. We can also explain these by telephone or email correspondence if so requested.

Orders will be dispatched as soon as possible after an order is accepted. We will deliver products to you as soon as reasonably possible, and within 30 days after the day your order has been accepted by us.

We are not responsible for delays that are outside of our control. If we are made aware of delays in delivery by events out of our control, we will endeavour to contact you and attempt to minimise the effects of this delay.

If, when the product is delivered there is no one available at your address to take the delivery, or the products cannot be posted through your letterbox then they will be left according to the instructions you have provided. If no instructions to leave the parcel are provided or it is not possible to do so, then the courier will leave you a note with information about rearranging delivery or collection from a local depot. A product will become your responsibility from the time we have delivered the product to the address supplied by you.

16) Ending the contract – the right to change your mind.

As a consumer you have a legal right to change your mind within 14 days and receive a refund for most products bought through our website.

Under the Distance Selling Regulations for purchases by phone or online, you are entitled to a full refund if your request is made in writing, within 14 working days of receipt of goods by you or received by someone nominated by you.

You do not have the right to change your mind if; you are a business, the products have a shelf life less than 28 days, products sealed for health or hygiene purposes (this applies to bird food if it has been unsealed after you receive it), or products (such as seeds for example) that have been mixed together after delivery and are subsequently then considered as inseparable.

If goods are split up, and are to arrive over different days, in several different deliveries then you have up to 14 days after the last good is delivered to you or received by someone nominated by you to change your mind.

17) Ending the contract – where there is no right to change your mind.

You may contact us to end your contract with us before completion (‘completion’ of the contract means the product has been delivered and paid for).

18) Ending the contract – How to end the contract, return of goods and refunds.

If you wish to return goods to us, please contact us by telephone, email or via the contact form on our website. Please include your name and address, the products you ordered, when you ordered or received them and any relevant order numbers.

We will happily pay return postage if products are faulty or errors in pricing or product description lead you to end the contract.

If you decide to end a contract for any other reason after having received the products or if they have already been dispatched, then you must return them to us. Please post them back to us in the best possible condition and well packaged. You must send the goods off to us within 14 days of informing us of your intention to end the contract. If you are responsible for the costs incurred to return the products and we are asked by you to arrange to have the product collected, we will charge you the direct cost to us of collection.

We endeavour to make any refunds promptly. If you are entitled to a refund, we will refund you by the method you used for payment. Consumers exercising their ‘right to change your mind’ will be refunded within 14 days of us receiving the product back, or within 14 days from the day you provide appropriate evidence of sending the product back to us.

If you fail to take care of the goods before they are returned to us, and this results in damage or deterioration then if we have already refunded you the price paid before we were able to inspect the goods then you must pay us an appropriate amount.

19) Missing, incomplete or damage goods

In the unlikely event of your order arriving damaged, incomplete or if it fails to arrive at all, please let us know as quickly as possible, to enable us to offer a swift resolution.

If your products unfortunately arrive damaged, we will be happy to replace them.

20) Ending the contract – our rights.

We may end the contract for a product at any time by writing to you if; you do not make any payment to us when it is due, you have not allowed us to deliver the product to you within a reasonable time or if there is a problem with the product.

When completing your order please click on the button marked ‘I Accept’ if you accept our terms and conditions. If you refuse to accept the above terms and conditions you will not be able to order any products from our site.
